New or Changed Rules New rules are those defined as effective within the last two calendar years and administered by the North Dakota Department of Health. New changes to existing rules are also included.Underground Storage Tank Program Changes to the Underground Storage Tank (UST) rules went into effect on January 1, 2009 to help prevent releases from underground storage tank systems, and to comply with requirements contained in the federal Energy Policy Act (EPAct) of 2005. The amendments require secondary containment with interstitial monitoring for all new piping and tank installations. The amendments also provide the state with "delivery prohibition" authority for tank systems that do not meet certain criteria regarding construction and operation of underground tank systems. These changes affect gas stations, government entities and owners of underground storage tanks used to store petroleum products. The secondary containment and monitoring requirements can be found in Section 33-24-08-10. North Dakota Administrative Code (NDAC).
