Polychlorinated Biphenyls

Polychlorinated biphenyls (PCB's), are regulated under the Toxic Substances Control Act (TSCA). In North Dakota, PCB's are not considered to be a hazardous waste.

Regulations concerning PCB's may be found in Title 40 Code of Federal Regulations (CFR), Part 761. North Dakota is not authorized to implement these regulations, but has entered into a cooperative agreement with the Environmental Protection Agency (EPA) to conduct inspections of facilities for proper disposal of PCB wastes. A representative of the Hazardous Waste Program conducts the inspection and prepares an inspection report which is sent to EPA Region VIII for compliance evaluation and enforcement actions.

The most commonly regulated sources of PCB's are a leaking PCB containing fluorescent lamp ballast or 10 non-leaking PCB ballasts from 4-foot long fluorescent lamp fixtures which are placed in a landfill.
