Air Toxics & Hazardous Air Pollutants (HAP)

The North Dakota Air Pollution Control Rules Chapter 33-15-13 (i.e. 40 CFR 61) and Chapter 33-15-22 (i.e. 40 CFR 63) reference the Federal emission standards for hazardous air pollutants (HAPs) and are incorporated by reference. Sources must also comply with the Policy for the Control of Hazardous Air Pollutants in North Dakota (Air Toxics Policy). Emission limits are established in the permit to assure compliance with the Air Toxics Policy.

NOTE: For all listings above which contain the word "compounds" and for glycol ethers, the following applies: Unless otherwise specified, these listings are defined as including any unique chemical substance that contains the named chemical (i.e., antimony, arsenic, etc.) as part of that chemical's infrastructure.
