Air Toxics

The North Dakota Air Pollution Control Rules Chapter 33-15-13 (i.e. 40CFR 61)  and Chapter 33-15-22 (i.e. 40CFR 63) reference the Federal emission standards for hazardous air pollutants (HAPs) and are incorporated by reference.  Sources must also comply with the Policy for the Control of Hazardous Air Pollutants in North Dakota (Air Toxics Policy).  Emission limits are established in the permit to assure compliance with the Air Toxics Policy. 

Air toxics are also a part of the emission inventory process.  Those sources that emit air toxics are required to submit annual estimates of HAPs emissions.  The HAPs totals in tons per year are available for review in the Emission Inventory Reports section on this website.
